In exchange for the intangible value that the Participant will gain from participating in the program offered by Whole Life Change LLC dba The Dawson Chess Academy (“Company”), I, the participant myself, and/or the parent or legal guardian of the Participant, agree to the following terms on my own behalf, and/or on the behalf of the Participant:

1. Release. I fully and forever waive, release, and discharge the Company and its affiliates, officers, directors, employees, agents, successors, and assigns (“Released Parties”) from any and all liability, claims, and demands of any kind whatsoever that may arise from the Participant’s participation in the Company’s programs.  

I understand that this release discharges the Released Parties from any liability or claim that I may have against them with respect to any bodily injury, personal injury, illness, death, property damage, or property loss that may result from the Participant’s participation in the Company’s programs, whether caused by the negligence of the Released Parties or otherwise.

I understand that participation in the Company’s programs may be inherently dangerous and may expose the Participant to a variety of foreseen and unforeseen hazards and risks. I expressly and specifically assume such risks, including any and all risk of injury, harm, or loss.

1. Entire Agreement. This Agreement contains all of the understandings between the Company and me related to the subject matter contained herein. This Agreement supersedes all prior and contemporaneous understandings, discussions, agreements, representations, and warranties, both written and oral, regarding such subject matter.
2. Assignment. Neither the Company nor I may assign any rights or delegate any obligations under this Agreement without the other party’s prior written consent. 
3. Modification. No provision of this Agreement may be amended or modified unless the amendment or modification is agreed to in writing and signed by the Company and me.
4. Severability. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable in any respect, or enforceable only if modified, such finding shall not affect the validity of the remainder of this Agreement, which shall remain in full force and effect and continue to be binding on the Company and me. 
5. Governing Law, Jurisdiction, and Venue. This Agreement and all matters arising out of or relating to this Agreement shall be governed by and construed in accordance with the laws of the State of Connecticut. Any action or proceeding to enforce this Agreement shall be brought only in any state or federal court in Connecticut.
